Man jailed for sending ex-girlfriend a gun emoji

A man has been jailed for sending a gun emoji to his ex-girlfriend.

Bilal Azougagh, 22, was sentenced to six months (with three months suspended) in prison for sending her the emoji.

The small gun icon which accompanied a text message which was perceived as a ‘death threat in the form of an image’ by a court in Valence, France.

Azougagh, of Pierelatte, admitted sending the message containing the gun emoji in the summer of 2015.

The girl was a minor at the time., her lawyer said the message scared her to the point she ‘no longer dared come into town and suffered nightmares’.

Defence expressed doubt that the gun emoji could cause a negative impact on the girl’s frame of mind.

The court sided with the girl, stating the gun emoji could be perceived as a ‘real threat’.

Azougagh was ordered to pay €1,000 (£792) in damages.

Despite France having no legislation concerning emojis, the judge considered the gun icon to fall under article 222-17 of the French penal code – which covers death threats.
